Often, the provisions in the Indian Contract Act and/or the Sale of Goods Act have embarrassed the purchase officers because of their lack of knowledge and experience in their application.  This is more so in the case of Government purchases because the law consider the Government as a model purchaser and, therefore, places a higher responsibility on the officers.  On the other hand, the suppliers, particularly the large number of small scale industries, often find themselves highly, vulnerable because of lack of infrastructure and understanding of laws, rules and procedures relating to Tendering and Contracting. It requires specially qualified and experienced faculty of procurement specialists, Legal and Contracting experts to effectively deal with all aspects of Purchase Management, including Quality Assurance and problems of suppliers, and close interactions between experts and the officials who handle government purchasing and procurement on a day-to-day basis.
